ODM’S RESPONSE TO POLITICAL PARTY DISPUTE TRIBUNAL ORDER BARRING EXPULSION OF REBEL MPs

Edwin Sifuna, the Secretary General of the Orange Democratic Movement (ODM), has taken a strong and unyielding position against the recent directive issued by the Political Parties Disputes Tribunal (PPDT). The PPDT’s order temporarily halted ODM’s expulsion of three lawmakers accused of disloyalty to the party. Sifuna’s response reflects a steadfast rejection of the tribunal’s decision, highlighting ODM’s historical precedent of not complying with similar rulings in the past.

Sifuna specifically singled out PPDT Secretary General Desmond Tutu, expressing skepticism about the rationale behind the tribunal’s decision and its timing. He pointed to past incidents, like the one involving Dulo’s removal as the Senate Minority Whip, where PPDT’s ex-parte orders failed to maintain a fractured relationship. Sifuna concluded by questioning the wisdom of anyone celebrating ex-parte orders from the PPDT.

In a recent development, the court has intervened decisively by issuing temporary orders that effectively halt ODM from expelling three prominent members: Kisumu Senator Tom Ojienda and MPs Elisha Odhiambo of Gem and Felix ‘Jalang’o’ Odiwuor of Lang’ata. These orders, delivered by the Political Parties Disputes Tribunal on September 12, will remain in effect until a comprehensive hearing takes place.

The genesis of these temporary orders stems from a case filed just the day before, challenging the expulsion of these three individuals from the party. The allegations against them revolve around purported violations of ODM’s constitution and the Political Parties Act of 2011. These allegations are centered on their perceived alignment with a rival political faction and their opposition to decisions made by the party’s governing bodies.

Notably, a significant date is on the horizon, as the matter is scheduled for mention on September 25, emphasizing the importance of the ongoing dispute. It is crucial to acknowledge that the consequences of this expulsion extend beyond the three individuals and also encompass MPs Caroli Omondi of Suba South and Gideon Ochanda of Bondo.

In response to these unfolding events, ODM leader Raila Odinga strongly defended the party’s decision during a meeting with Migori County ODM delegates. He emphasized the paramount importance of unity and discipline within the party, asserting that these measures are vital for preserving ODM’s resilience and coherence.
